The hearing examiner may recommend to the board variances from the requirements of Chapters 16.04 through 16.44 provided any variance granted shall be subject to such conditions as will assure that it will not constitute a grant of special privilege inconsistent with the limitations upon other subdivisions and that the following circumstances are found to apply:
(1) Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of Chapters 16.04 through 16.44 is found to deprive the subject property of rights and privileges enjoyed by other developments;
(2) That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity.
