9.18.010 Litter control fee.
A ten dollar fee shall be levied against any person who transports solid waste to a county contracted or operated solid waste disposal site, transfer station, recycling facility or compost facility, if when entering the facility any portion of the waste is visible to scale house or fee collection personnel, unless the waste is only visible through a secure covering; provided, this provision shall not apply to loads that are not capable of causing or creating litter.

9.18.020 Appeal process.
Any person aggrieved by the decision of the facility scale house or fee collection personnel to levy a litter control fee pursuant to Section 9.18.010, may appeal that decision to the Kitsap County Assistant Director of Public Works – Utilities. Upon review of the appeal and evidence presented, the assistant director may uphold imposition of the fee, reduce the fee amount, or take other such action deemed appropriate under the circumstances.

9.18.030 Payment to county solid waste fund.
All litter control fees collected by the facility operator from persons violating Section 9.18.010 shall be paid monthly to the county by the facility operator and deposited within the county’s solid waste fund. Moneys collected shall be used for county-wide litter control or litter collection purposes, cleanup of illegal dumping activities on public property, or general public information and education activities related to litter control or illegal dumping activities.

9.18.040 Facility operator’s compliance.
All solid waste facility operators under contract to the county shall enforce the provisions of Sections 9.18.010 through 9.18.030. All solid waste facility operators shall develop written procedures that must be approved by the county director of public works, which will be used in the implementation, record keeping and enforcement of said sections.

9.18.050 Vehicle transporting.
A vehicle transporting sand, dirt, or gravel in compliance with the provisions of RCW 46.61.655 shall not be required to secure or cover a load pursuant to the provisions adopted under the ordinance codified in this chapter.
